Hi Jeff! I'm SO sorry for the delayed response. I'm new here and the notice that someone left a comment fell directly into an e-mail folder. To your two questions: first, I don't believe anything material has changed since Orin Kerr wrote the article, which is a primer and therefore a nuts-and-bolts deconstruction of court cases (which haven't really changed much in a very long time). Second, alas, to the best of my knowledge I am unrelated to any Kerr of notoriety.
